Lawyer defending criminals in court

Q: I am a lawyer by profession. I represent people who are being prosecuted for criminal charges and defend them in court.

In many instances, the accused party confesses to me that they are guilty of the crime for which they are being charged, even though they plead 'not guilty' to the court.

In such situations, is it permissible for me to defend the accused in court, knowing that I am defending a guilty person who is lying to the court?

A: Islam has prohibited defending and supporting those who are on wrong.

Rather, Islam advocates justice and strongly commands that we assist the oppressed against the oppressor.

Hence, it is not permissible for you to defend a person who is guilty of the crime.



And Allah Ta'ala (الله تعالى) knows best.

لا يجوز أخذ الأجرة على المعاصي (كالغناء والنوح والملاهي) لأن المعصية لا يتصور استحقاقها بالعقد فلا يجب عليه الأجر وإن أعطاه الأجر وقبضه لا يحل له ويجب عليه رده على صاحبه (مجمع الأنهر 2/384)
(ولا بأس بالدخول في القضاء لمن يثق بنفسه أن يؤدي فرضه) لأن الصحابة رضي الله عنهم تقلدوه وكفى بهم قدوة ولأنه فرض كفاية لكونه أمرا بالمعروف (ويكره الدخول فيه لمن يخاف العجز عنه ولا بأس على نفسه الحيف فيه)كي لا يصير شرطا لمباشرته القبيح وكره بعضهم الدخول فيه مختارا لقوله عليه الصلاة والسلام (من جعل على القضاء فكأنما ذبح بغير سكين) والصحيح أن الدخول فيه رخصة طمعا في إقامة العدل والترك عزيمة فلعله يخطئ ظنه ولا يوفق له أو لا يعينه عليه غيره ولا بد من الإعانة إلا إذا كان هو أهلا للقضاء دون غيره فحينئذ يفترض عليه التقلد صيانة لحقوق العباد وإخلاء للعالم عن الفساد (الهداية 3/132)
